These Terms of Service ("Terms") govern your use of The Scene by MYai application (iOS & Android), the website at thescene.world, and all related services (collectively, the "Service"), operated by MYai ("MYai," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old (or 16 in the European Economic Area) to use the Service. If you are under the age of majority in your jurisdiction, you must have parental or guardian consent.
When you install the app, a device-generated MYai ID is created. You are responsible for maintaining the security of your device and account credentials. You agree to notify us immediately of any unauthorized use.
The Scene by MYai is a music-themed social media platform that combines virtual social with reality social. Core features include:
TheScene event features (ticketing, POS, guest checkout, check-in, SuperFan, User Class add-ons) are available via paid subscription. Additional modules may be introduced in future updates.
New users receive a 33-day free trial with all features unlocked. No payment information is required to start the trial. When the trial ends, free-tier features remain available; premium features require a subscription.
6.1 App Store Subscription: $5.99 per week, billed through the Apple App Store or Google Play Store.
6.2 Payment Processing: Payments are processed by the applicable app store. By purchasing a subscription, you agree to their respective terms of service and payment policies.
7.1 Cancellation: You may cancel your subscription at any time through the Apple App Store or Google Play Store settings.
7.2 Cooling Period: After cancellation, a 60-day cooling period preserves your local data and account state. During this period, you may re-subscribe without losing any data.
7.3 Refunds: App Store refunds are handled by Apple or Google per their policies. TheScene ticket refunds are subject to the event organizer's refund policy and any applicable local consumer protection laws.
If you create events via TheScene, you are the "Event Organizer" and are solely responsible for: the accuracy of event details, compliance with local regulations, fulfillment of ticket purchases, and any refund obligations. MYai acts as a technology platform and is not a co-organizer, venue operator, or ticket reseller.
Ticket buyers agree that: tickets may be non-transferable unless the Event Organizer enables transfers, and event cancellation refunds are at the discretion of the Event Organizer (subject to applicable law).
You retain ownership of all content you create or upload. By using features that transmit content to our server, you grant us a limited, non-exclusive, royalty-free license to host, display, and distribute that content solely to operate the Service. You may delete your content at any time.

The Service, including its design, code, logos, and documentation, is owned by MYai and protected by copyright, trademark, and other laws. You may not use our trademarks without prior written consent.
If you believe content on the Service infringes your copyright, send a DMCA takedown notice to legal@myaiuser22.com with: (a) identification of the copyrighted work, (b) identification of the infringing material, (c) your contact information, (d) a statement of good-faith belief, and (e) a statement under penalty of perjury that the information is accurate.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
The Scene is not a medical, legal, financial, or emergency service.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYAI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50.00 USD.
You agree to indemnify and hold harmless MYai and its affiliates from any claims, damages, losses, or expenses arising from: (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any rights of another party.
Any dispute shall first be resolved through good-faith negotiation. If unresolved within 30 days, either party may pursue binding arbitration under the rules of the American Arbitration Association (AAA). The exclusive venue shall be the United States District Court for the Eastern District of Texas (Marshall Division), or the state courts of Harrison County, Texas. Class actions and class arbitrations are waived to the extent permitted by law.
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law provisions.
We may suspend or terminate your access to the Service at any time for violation of these Terms, fraudulent activity, or as required by law. Upon termination, your right to use the Service ceases immediately.
The Service contains proprietary AI models, neural network weights, LoRA modules, and RAG data stores ("AI Assets"). These are protected by trade secret law, copyright, and patent (pending). You agree that you will not reverse-engineer, copy, transfer, distribute, or extract any AI Assets. All AI Assets contain forensic watermarks unique to your account. Unauthorized distribution will be traced and prosecuted.
The Service employs automated runtime integrity verification systems. Any detected anomaly is logged and evidence is preserved for legal proceedings. MYai reserves the right to seek all available legal remedies including statutory damages under 17 U.S.C. § 1203, trade secret claims under the Defend Trade Secrets Act, and CFAA claims.
We may update these Terms from time to time. If we make material changes, we will update the "Last Updated" date and, where feasible, notify you via the app or email. Your continued use constitutes acceptance.
If any provision is found unenforceable, the remaining provisions remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MYai regarding the Service.
